- Union organizer claimed she and others were improperly classified under the administrative exemption. The court denied plaintiff's class certification claims and proceeded on individual wage and hour and 17200 Business and Professions Code claims seeking damages for overtime, missed meal and rest periods, penalties and interest. Plaintiffs claimed they had been misclassified as independent contactors, notwithstanding a written contract defining them as such, entitling them to overtime, premium pay for missed meal periods, penalties and pre- judgment interest. The defense claimed that Plaintiffs were properly classified as independent contractors, that their claims of hours worked were erroneous and that the claimed regular rate of pay failed to account for a piece rate. Settled.
- One of the largest ever wage and hour class actions in California involving 48,000 employees with a class period spanning fourteen years against a national janitorial company; claims alleged meal period, split shift and mileage reimbursement violations. Settled.
- Disability discrimination, failure to accommodate and retaliation claims by a news reporter against a Fortune 500 media company and alleging that a subarachnoid hemorrhage was caused by the employer’s conduct. Settled.
